Personal data
Personal data means any information or data that can be used to identify you either directly (e.g., your name) or indirectly (e.g., through pseudonymized data such as a unique identification number). This means that personal data includes data such as e-mail/private addresses/mobile phone numbers, usernames, profile photos, personal preferences and user-generated content, financial data, and information relating to physical characteristics. It may also include unique numerical identification data such as your computer’s IP address or your mobile device’s MAC address, as well as cookies.
Scope of personal data processing
I only process personal data in the following cases:
- when I provide you with legal services,
- when you fill out the form on my website called the contact form,
- when you visit my website,
- when we communicate by phone, email, or social media.
Purpose of personal data processing
Performance of a contract
In connection with the provision of legal services, I process your personal data and, where applicable, the personal data of third parties (e.g., your employees, clients, etc.) that you provide to me in the course of my legal practice. This data is necessary for the fulfilment of my obligations under the contract for the provision of legal services.
Typically, this includes:
- first and last name,
- date of birth,
- personal identification number,
- company ID number,
- tax ID number,
- address of residence or registered office,
- contact details,
- bank account number,
- and any other data you provide to me in the course of our cooperation.
The legal basis for the processing of this data is the performance of a contract. I store personal data for the duration of the contractual relationship, or for the duration of the provision of legal services, and subsequently for a period of ten (10) years after its termination, in accordance with legal regulations and the obligations of a lawyer.
Compliance with legal obligations
Independent lawyers are subject to a number of legal and professional obligations, the fulfilment of which often requires the processing of personal data. These obligations arise in particular from Act No. 85/1996 Coll., on the legal profession, and Act No. 253/2008 Coll., on certain measures against the legalization of proceeds from crime (the so-called AML Act).
While fulfilling these obligations, I process only personal data that are necessary and whose processing is required by the relevant legal regulations.
This typically includes:
- first and last name,
- date of birth,
- personal identification number (if relevant),
- company ID number and tax ID number,
- permanent address or registered office.
The legal basis for such processing is the fulfilment of a legal obligation. I store personal data for the period specified by the relevant legal regulations.
Handling your requests based on contact
If you have contacted me via the contact form on my website, by phone, e-mail, social media, or other means, I process your personal data for the purpose of handling your inquiry or request.
I typically process the following personal data:
- first and last name,
- email address,
- phone number or other contact details.
The legal basis for this processing is the implementation of measures taken prior to entering into a contract at your request. I store your data for the time necessary to process your request and then for a further period of three (3) years for the protection of legal claims.
Legitimate interest
I may also process your personal data for the purpose of protecting my legitimate interests, those of my clients, or other persons.
Most often, this involves data such as:
- first and last name,
- date of birth,
- personal identification number,
- company ID number,
- tax ID number,
- address of residence or registered office,
- contact details,
- bank account number
- and other necessary information provided to me.
The legal basis for this processing is my legitimate interest. I store personal data processed for this reason for a period of three (3) years from the start of its processing, unless otherwise provided by law (e.g., laws governing the practice of law) or unless the specific circumstances of the case justify storage for a longer period in order to protect the legitimate interest in question.
Transfer of your personal data
I primarily process personal data myself using my own resources, but in some cases, personal data may also be processed by other processors. I only transfer your personal data in necessary cases – to public authorities, if I am required to do so by law, and to reliable third parties who provide services for me as contractual partners, such as providers of cloud services, e-mail or other software tools and IT infrastructure, who provide me with software, services, and applications, such as cloud service providers, email providers, or other software tools and IT infrastructure. I do not transfer your personal data to any of my business partners without your express consent.
The transfer of personal data to these entities is always carried out in accordance with applicable law and using appropriate security measures to protect your personal data.
